FCC Aqualia S.A. (hereinafter Aqualia or the organisation), with registered office in Madrid (Spain) and tax identification number A26019992, to hold the Day against Gender Violence on 25 November 2020, is organising a campaign for participation by its employees and citizens where Aqualia provides services, through a specific website and Twitter which will be regulated in conformity with these Legal Basis (hereinafter the Basis).
The campaign organised by Aqualia consists of the participation of the employees and citizens where Aqualia provides services, by sending us, through the platform www.aqualiacontigo.com (hereinafter platform) a picture with their hands extended to form a virtual chain. We also give the option to upload the picture on Twitter and for employees to send these pictures to Aqualia's Communication and CSR department. Among these photos, some will be selected for the development of a promotional video to be distributed to the media, social networks, etc.
The first 100 people to register on the platform will receive a T-shirt with the campaign design as a gift.
The campaign will be active from 00:00 (GMT+1) on 04/11/2020 until 00:00 (GMT+1) on 25/11/2020.
In the case that, for reasons of force majeure or beyond Aqualia's control, it is necessary to postpone or modify the duration of the campaign or to cancel or repeat it, the participants will be notified of this fact through the Platform or by e-mail or other internal communication tools of Aqualia.
The campaign organised by Aqualia is destined to the participation of all the workers who are members of the company, as well as its subsidiaries and joint ventures in Spain, Colombia, Mexico, the United States, Egypt, the United Arab Emirates and Saudi Arabia.
Citizens of the municipalities in which Aqualia (and its subsidiaries and JV and Mixed companies) provide services may also participate.

For the good development of the Campaign it will be necessary that the personal data of the participants, collected through the Platform, be true, complete and current, to which they commit themselves through the acceptance of these Basis. If the personal information of a participant in the Campaign is uncertain, false, incomplete or not updated in such a way that the identification of the participant is impossible by reasonable means, Aqualia reserves the right to disqualify them from the Campaign, being free of any responsibility in this respect.
For the correct development of the campaign, it is necessary that the User consents to the processing of their personal details (including the image) so they can be distributed and displayed by any mean, physical or digital, and/or in the internal/external location considered to be of interest to Aqualia and/or the rest of the Group's Entities (whose addresses and activities are mentioned on the website www.fcc.es) at a worldwide level, with the only purpose of carrying out the actions specified above.
Likewise, in the case that the photograph presented to the campaign shows the image of a third person, the participant assumes the obligation to inform about the present Legal Basis, and in particular about the Personal Data Protection information, as well as having obtained the express consent of the third person for the processing of their image by Aqualia under the terms and for the purposes indicated in this section. At any time, Aqualia may request the existence of this consent.

The purpose for which we process the personal data you have provided for registration is the development, management and distribution of the campaign.
The legitimacy for the processing of the personal data (name and surname, image, voice, and/or any other personal data) provided is the execution and development of the campaign and the consent that you have given, if applicable, for the processing of your personal data and/or, if applicable, that of the third party that you have previously informed and obtained your consent, for the distribution of this data on Aqualia's Social Networks and/or other physical and digital media.
Your personal data will be kept for the duration of the campaign and advertising, or you can request its deletion. Once this distribution has been completed, we will keep your personal data blocked for the legally prescribed period. Once this period has expired, we will destroy your data.

By accepting these Basis, the participants give Aqualia, on an exclusive and voluntary basis, the image rights, as well as any other rights that may belong to them as a result of their participation in the Campaign and which may be the object of public communication through various media (websites, magazines, newspapers, social networks, etc.)
To this end, the participant, if he/she has given his/her consent to Aqualia, authorises it to use the photograph or photographs submitted for participation and the participant's personal details that may be collected during the course of the Campaign, in order to allow their exploitation by any modality, for everyone and without time limit.
Aqualia informs the stakeholders that the processing of the personal image and identification data provided necessarily involves the communication of the data of the participants and winners to any third person with access to the media and communication channels where the data of the stakeholders is reproduced, published or publicly communicated. When the reproduction, public communication or publication of the personal data of the interested persons is carried out in communication media accessible from any country in the world, such as the Internet, the processing of the data will involve a processing of data with universal scope so that even third persons located in countries without regulations on the protection of personal data or with regulations that have a lower level of protection than that provided by Spanish regulations, will be able to access the data.
The participant guarantees that he/she is the only owner of the intellectual property rights of each of the photographs and messages presented in the Campaign through the platform www.aqualiacontigo.com and is totally responsible for the absence of third party rights in the published content, as well as for any claim by third persons for image and/or intellectual property rights.
Participation in the Campaign means the exclusive and transferable assignment, on a worldwide basis, for the entire duration of the intellectual property rights and free of charge by the participant to Aqualia, of all the exploitation rights deriving from the creations with which he/she participates in the Campaign.
The concession of intellectual property rights as set out in these basis, does not generate or provide any refund, payment of fees or taxes or economic rights of any kind for the participant.
Aqualia reserves the right to cancel any participation or any participant, if there is any suspicion of incorrect data or campaign manipulation.
The organisation reserves the right to refuse or exclude from participation in the Campaign any participant who does not meet the requirements described in these basis and terms of participation or contravenes the rules or purpose of the Campaign.
The organisation is not responsible for the incorrect functioning of the platform, nor for any loss of data due to e-mail problems and/or the incorrect functioning of the internet.
Furthermore, the organisation excludes any responsibility for damages of any kind that, despite the security measures adopted, may be due to the improper use of the services and contents by users, and in particular, although not exclusively, for damages of any kind that may be due to the impersonation of a third person carried out by a user in any kind of communication carried out through the Platform.
If any provision of these Basis were to be declared totally or partially null and ineffective, such nullity or ineffectiveness would affect only that provision or part thereof that is null and ineffective, with the rest of the Basis subsisting in all other respects and such provision or part thereof that is affected by its non-application, unless, as it is essential to these Basis, it would affect them in an integral way.
These Terms and Conditions shall be interpreted and governed in accordance with Spanish law. For any litigious matter derived from the existence, access, use or content of the Conditions, the participant and Aqualia expressly renounce any other jurisdiction that may correspond to them, submitting themselves to the jurisdiction and exclusive competence of the Courts and Tribunals of Madrid.
